Estate Agency Terms of Business

This document clearly sets out what is expected of the seller as well as what the agent will do.

There are separate sections for the various services that an agent will offer: Sole Agency; Sole Selling Rights and Multiple Agency

Lettings Agency Terms of Business

This document clearly sets out the responsibilities of the landlord (particularly in regard to safety legislation) as well as the services that the agent will provide.  The latest version includes provisions for the implications of The Tenant Fees Act, as well as compulsory client money protection and the extra responsibilities of the Fitness for Habitation Act.

There are separate sections for the various levels of service which an agent may offer: Find Tenant Only; Rent Processing; and Full Management.

Both standard templates are regularly reviewed and updated to keep abreast of legislation, judicial precedence and best practice. They both include the required documentation to enable cancellation.

They are provided as a Microsoft Word document for the agent to adapt to their particular business and personalise as required. Areas where the agent needs to insert their own information are clearly highlighted.

The cost of both of these documents is inclusive of a follow-up one-to-one telephone session to go through any points to ensure understanding and in order that we can discuss with you how best they can be tailored to suit your agency’s requirements.

Applicant/Prospective Tenant Advice and Confirmation Document

The Tenant Fees Act now puts even greater emphasis on the need to make clear to all applicants what they can expect when applying for a tenancy and exactly what is involved in paying a holding deposit.

This two part document is designed to ensure that the applicant knows want is involved for them if they wish to rent a property through you (the agent) and comes in two parts:

Part One:  to be provided when they express an interest in looking at a property through you and before they commit themselves to an application.  This information sheet outlines the things that need to be considered before agreeing to apply for a tenancy.

Part Two:  is a signed confirmation that they have understood the contents of Part One and agree that they will be bound by the specific provisions of that tenancy application once the holding deposit has been paid.

Terms and Conditions for Instructing Contractors

All property managers should have a robust contract with all their contractors in order to ensure consistency of service to the tenants and to minimise risks to themselves and their landlords.

This document once signed by you (the agent) and the contractor becomes a binding contract and is designed to ensure that the relationship between agent and contractor is fully spelled out and documented.
